Our suggested contribution is $500-$1000 per rental property.

The arbitrary temporary membership restrictions (4 summer and 2 additional, Saturday to Saturday, 7 day minimum) are NOT LEGAL or FAIR. 

 

• Attorneys who specialize in HOA and Club law have determined that Lake Naomi Club (“LNC”) is not authorized to impose any restrictions on Temporary Memberships.

• Fact: LNC cannot restrict the duration (number of days) or specify the timing (currently Sat. to Sat) of temporary memberships.

• Further, while LNC does not allow homeowners to sponsor TMs of less than a week, guests of Mountaintop Lodge (which is operated by LNC) are offered temporary memberships of any duration or timing. 

• Fact: LNC is also not authorized to require Full Memberships in order to purchase Temporary Memberships. Couples memberships are not excluded by the by-laws

• Fact: Since LNC began restricting rentals, membership dues have increased significantly (10% per year each year for the past 2 years alone)   

• LAKE NAOMI FOR ALL, LLC (LNFA) was organized to challenge LNC’s arbitrary restrictions on rentals, with the goal to restore Logan Steele’s clear intention, He clearly articulated his belief that  unlimited temporary memberships should be offered to anyone occupying a home for any period, to promote growth of the community and home values

• Substantial due diligence performed by a team of expert HOA/Club specialist attorneys has determined that this restriction is not allowed in the establishing documents or anything since Thus, LNFA initiated legal action to challenge LNC’s arbitrary membership restrictions..  

• The lawsuit filed by LNFA in March 2024 seeks to reinstate and protect the rights of all HOA members, specifically the right to sponsor unlimited TMS to guests in our homes (whether renters or gratuitous guests). 

• To date, LNFA has spent nearly $20K in legal fees to defend their untenable positions. This is just the beginning. We expect LNC to aggressively defend their position.

• Our legal counsel estimates that the ongoing cost (22K already spent) of litigation will cost $50,000, and we need $15,000 now.  

• This $15,000 will be used to support the ongoing litigation for the next few months.

• Your financial contribution goes directly to pay for legal fees. 

•  Protect your family’s investment by supporting the litigation.
